Towards a Children’s Curfew Law in Malaysia: An Exploration of Social Bond Theory and Parens Patriae Doctrine

Abstract
  • Juvenile delinquency and victimisation are at the heart of the discussion on child protection systems in Malaysia. Growing cases of juvenile delinquency and victimisation signal that the current approach in addressing the issue leaves much to be desired. In proposing children’s curfew law in Malaysia, this article explores the theoretical foundations in support of the law namely the Social Bond Theory and Parens Patriae doctrine. By employing doctrinal legal research, this article examines primary legal sources in statutes and case laws as well as secondary sources in previous literature relevant to the topic. This article concludes that there is strong prospect for children’s curfew law in Malaysia, and the two theories may provide reasonable justifications for introducing the law in the country.
