Abstract
  • Anti-corruption laws seek to prevent and punish administrative corruption and bribery. The primary anti-corruption laws in Afghanistan are the Anti-Corruption Mechanism 2016, the Anti-Administrative Corruption Act 2018, and the Procedure for Combating Administrative Corruption and Supporting Whistleblowers of Administrative Corruption Crimes 2019, which were enacted in light of the provisions of Article 7 and paragraphs 3 of Article 75 of the Constitution 2004. The existence of weaknesses in these laws, such as Article 21 of the Anti-Administrative Corruption Act 2018; a lack of political will to uphold these laws; a lack of a coherent strategy against corruption; impunity in the judiciary; foreign-backed strategies, namely in reforming programmes; and nepotism and warlords interventions in decision-making made them vulnerable to the administrative corruption.
