Education practices in university and higher education level have some challenges, one of the challenges is plagiarism conducted by student. Plagiarism is also recognized as an academic crime because it is not only with the evil intention but also violate some laws and regulations, for instance copyrights law. However, plagiarism itself not regulated directly on criminal code and not recognized as a crime. The research is intended to examine and analysis how the bias of laws and regulation concerning to plagiarism cases in Indonesia and Malaysia. The research is also dedicated to describe more about the facts of plagiarism among student and its implementation of its laws and regulation. Deductive analysis which means we analyse the theories and opinions of experts which we then cite. The purposes of this paper are to highlight and emphasize on plagiarism policies between Malaysia and Indonesia, its effectiveness towards students and the public, how firm the government is towards the regulations, and sanctions when violating the regulations. Therefore, we are expected to be critical and honest, higher creativity, reinforce and reduce plagiarism copyright infringement, and add insight and knowledge to students about plagiarism. The research used a normative research which analyse laws and regulations on plagiarism. The research is not field research, the data collected from online and offline sources, and report of cases. The plagiarism activities stipulated in some provisions, in Indonesia Ministry of Education Regulations Permendiknas No. 17 of 2010 is one of legal basis for solving plagiarism, as well as in Malaysia, there is Kaedah 6, Kaedah-kaedah Universiti (Tatatertib Pelajar Tahun 1999) di bawah Akta Universiti dan Kolej Universiti 1971 (AUKU). Those provisions just describe concerning to the preventing of plagiarism not about criminal sanction. The sanction of plagiarism is only administrative sanctions and fine, not criminal sanctions. Indeed, this condition has become a serious problem, especially in the academic pedagogy in the 21st Century. The problems in the culture of plagiarism among students can occur due to various reasons, such as lack of confidence, laziness, and the lack of knowledge of students about good writing procedures following the rules.
