Abstract
  • The introduction of the Medical Act 1971 (amended 2012) and Medical Regulation 2017 has significantly impacted how medical disciplinary proceedings in Malaysia are carried out. The amendment’s purpose was to help strengthen the functionality of the Malaysian Medical Council (MMC) as a statutory body governing medical doctors in Malaysia. Changes in medical disciplinary proceedings brought through the introduction of the amended provisions had been fleetingly touched upon in recent years. The focus of this paper is to compare the pre and post amendments to the disciplinary proceedings. Hence the medical disciplinary process were studies in depth through qualitative means. Findings suggest that there are several weaknesses in the disciplinary procedures that should be addressed to ensure that a balance is struck between public interest and the rights of medical practitioners.
