Indonesian hajj fund management: An overview

Abstract
  • In Indonesia, the management of hajj funds is carried out by the Hajj Financial Management Agency or abbreviated as BPKH – Badan Pengelola Keuangan Haji. This year, around 120 trillion rupiahs of hajj funds are managed, an increase of 10 trillion rupiahs from the previous year. Currently, the Indonesian government has a discourse to invest Hajj funds in the infrastructure sector. This study aims to contribute to the understanding of hajj fund management institution in Indonesia in term of law and contract applied. This study used the descriptive qualitative method. Data obtained through literature review and interview. This preliminary study concludes that (1) legally, the management of financial pilgrimage in accordance with Law No. 34 of 2014 concerning Financial Management of Hajj. However, the investment of hajj funds into the infrastructure sector has not been clearly stated in the Act; (2) In terms of contracts applied, the contract between pilgrims and the recipient bank (BPS BPIH – Bank Penerima Setoran Biaya Penyelenggaraan Ibadah Haji) uses a wadi’ah contract, while the contract between the Pilgrims and BPKH is a wakalah contract. However, in the implementation of the wakalah agreement, it was not clearly stated that the management of the hajj funds was placed and/or invested according to Law No. 34 of 2014 concerning financial management of the pilgrimage.
